Regulatory overview

Spain financial markets regulator is the CNMV (Comision Nacional del Mercado de Valores). Forex and CFD trading is legal for Spanish retail clients within the EU MiFID II framework and the ESMA product-intervention measures: leverage capped 30:1 to 2:1 by volatility, 50% margin close-out, negative-balance protection. [S1] By Resolution of 11 July 2023, the CNMV imposed national measures on CFDs marketed to retail investors in Spain: leverage limits, a 50% margin close-out, account-level negative-balance protection, a prohibition on incentives, and restrictions on advertising and on demo accounts/general training.
